Justice Timothy Kelly, on May 10, decreed that these accounts should be seized and transferred to the US due to their alleged involvement in North Korean cryptocurrency thefts. The exact sum implicated in the case is yet to be revealed.
The Background
The judgment arises from a case initiated by the US government in August 2020, which accused North Korean-related entities of transferring illicit crypto funds to exchanges outside the US or to unhosted wallets under foreign conspirators’ control.
The case initially targeted 280 accounts, but one virtual account was removed two years post-filing.
The money laundering scheme involved concealing the origins of the pilfered cryptocurrencies and subsequently converting them into fiat currency, allowing North Korea to circumvent sanctions.
Challenges in Deterrence and Recovery
Dennis Desmond, a cybersecurity lecturer at the University of the Sunshine Coast, noted that the US has had limited success in deterrence or recovery in the crypto theft space. He added that implementing “meaningful countermeasures” against North Korean agents operating outside the traditional system is difficult.
Additionally, the recent judgment ordered the seizure of 134 virtual wallets linked to two cryptocurrency exchange hacks in 2019. The criminals stole over $270,000 from one of the platforms and hid the funds through a series of transactions involving other exchanges, a process known as “chain hopping.”
Chain hopping involves laundering illicit funds by converting them into different types of cryptocurrencies, using falsified KYC information, and employing VPNs to conceal locations. According to court documents, many of the IP addresses used in this process were identical to those used in previous heists by North Korean attackers.
This recent development follows a March ruling by Justice Kelly that ordered the seizure of 145 crypto accounts involved in laundering stolen funds from four crypto exchanges between 2018 and 2019. The attackers managed to steal approximately $330 million in funds, with the largest attack resulting in a loss of $250 million from a single platform.
In 2023 alone, North Korean hackers were responsible for $430 million in cryptocurrency losses. A UN report in March highlighted that the nation generated around 40% of its revenue to fund weapon development through these cyberattacks.
In response to these developments, the government has intensified its oversight of the crypto sector and has taken action against crypto mixing services.
